TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of Growing Calendar (also called the Cultivo Ornamental Online Scheduling System), the appointment booking app available at www.cultivoornamental.com (the "Service"), operated by Cultivo Ornamental, based in Brazil ("we", "us" or "our"). By signing in and booking an appointment, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
The Service lets clients book an appointment with Cultivo Ornamental online. It is free of charge. To book, you:
• Sign in with your Google account and grant the permission https://www.googleapis.com/auth/calendar.events.owned, which the Service uses only to create the appointment event in your Google Calendar.
• Choose an available date and time, shown in the Brasília time zone (GMT-3).
• Fill in your full name, your Google account email, your WhatsApp number and the appointment type: First consultation, Consultation or Follow-up visit.
When you confirm, the Service creates the event in your Google Calendar and invites Cultivo Ornamental (calendario.cultivoornamental@gmail.com) as a guest, so we are notified of your booking. Each booking reserves a period of 3 (three) hours from the selected start time.
How we handle your data is described in our Privacy Policy, which forms part of these Terms.
2. Eligibility
You must be at least 18 years old and have a Google account to use the Service. By using it, you confirm that the information you provide is true, accurate and your own.
3. Your Responsibilities
You agree to:
• Provide your real name, the email of the Google account you signed in with, and a WhatsApp number where we can reach you.
• Choose the appointment type that matches your situation (First consultation, Consultation or Follow-up visit).
• Use the Service only to book appointments with Cultivo Ornamental.
• Keep your Google account secure and not book on behalf of other people without their permission.
• Comply with applicable laws.
4. Prohibited Conduct
You may not:
• Make false, fraudulent or duplicate bookings, or book time slots with no intention of attending.
• Use another person's name, email or phone number, or otherwise impersonate someone.
• Use bots, scripts or other automated means to access the Service.
• Attempt to disrupt the Service, access it without authorization, or collect information about other clients.
• Transmit viruses or any harmful code.
We may cancel bookings and block access to the Service for anyone who breaks these rules.
5. Appointments, Confirmation, Rescheduling and Cancellation
• Confirmation: a booking made in the Service reserves the time slot. We may contact you by WhatsApp or email to confirm the details.
• Rescheduling or cancellation by you: please tell us by WhatsApp or by email at calendario.cultivoornamental@gmail.com, preferably at least 24 hours in advance. You may also delete the event in your Google Calendar; when Google asks, choose to notify the guests so we are informed.
• Rescheduling or cancellation by us: if we need to change or cancel an appointment, we will let you know as early as possible by WhatsApp or email and offer a new time.
• Availability: times shown as available may change until you confirm. If two bookings conflict, we will contact you to arrange another time.
6. Google Services
The Service depends on Google Sign-In and Google Calendar. Your use of those services is also subject to Google's Terms of Service and Google's Privacy Policy. We are not responsible for outages or changes in Google's services.
You can revoke the Service's access at any time at myaccount.google.com/permissions. Revoking access prevents new bookings but does not delete events already created; you can delete them in Google Calendar.
7. Intellectual Property
The name Cultivo Ornamental, the Growing Calendar app, and the texts, design and graphics of the Service belong to Cultivo Ornamental and are protected by law. You may not copy, modify or redistribute them without our written permission.
8. Disclaimer and Limitation of Liability
The Service is provided free of charge, "as is" and "as available". We work to keep it running correctly, but we do not guarantee that it will be uninterrupted or error-free.
To the extent permitted by law, Cultivo Ornamental is not liable for indirect damages arising from the use of, or inability to use, the Service, including failures of Google services, internet connection problems or incorrect information provided by the user.
Nothing in these Terms excludes or limits rights you have under Brazilian consumer protection law (Código de Defesa do Consumidor — Law No. 8,078/1990) or other laws that cannot be waived.
9. Suspension and Termination
You may stop using the Service at any time and revoke its Google access as described in Section 6. We may suspend or discontinue the Service, or block a user who violates these Terms. If the Service is discontinued, appointments already booked will be honored or rescheduled with you.
10. Changes to These Terms
We may update these Terms. The "Last updated" date at the top shows the current version. For material changes, we will display a notice on the scheduling page before they take effect. If you continue using the Service after changes take effect, you accept the new Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. Disputes will be resolved by the courts of Brazil; if you are a consumer, you may file suit in the courts of your own domicile, as provided by the Código de Defesa do Consumidor.
12. Language
These Terms are available in Portuguese and English. If there is any conflict between the two versions, the Portuguese version prevails.

Estes Termos de Serviço ("Termos") regem o uso do Growing Calendar (também chamado de Sistema de Agendamento Online da Cultivo Ornamental), o aplicativo de agendamento disponível em www.cultivoornamental.com (o "Serviço"), operado pela Cultivo Ornamental, com sede no Brasil ("nós"). Ao fazer login e agendar um atendimento, você concorda com estes Termos. Se não concordar, não utilize o Serviço.
1. O Serviço
O Serviço permite que clientes agendem um atendimento com a Cultivo Ornamental pela internet. Ele é gratuito. Para agendar, você:
• Faz login com sua conta Google e concede a permissão https://www.googleapis.com/auth/calendar.events.owned, usada pelo Serviço apenas para criar o evento do agendamento no seu Google Agenda.
• Escolhe uma data e um horário disponíveis, exibidos no fuso de Brasília (GMT-3).
• Preenche seu nome completo, o e-mail da sua conta Google, seu número de WhatsApp e o tipo de atendimento: Primeira consulta, Consulta ou Retorno.
Ao confirmar, o Serviço cria o evento no seu Google Agenda e convida a Cultivo Ornamental (calendario.cultivoornamental@gmail.com), para que sejamos avisados do seu agendamento. Cada agendamento reserva um período de 3 (três) horas a partir do horário escolhido.
A forma como tratamos os seus dados está descrita na nossa Política de Privacidade, que faz parte destes Termos.
2. Quem Pode Usar
Você precisa ter pelo menos 18 anos e uma conta Google para usar o Serviço. Ao usá-lo, você confirma que as informações fornecidas são verdadeiras, corretas e suas.
3. Suas Responsabilidades
Você se compromete a:
• Informar seu nome verdadeiro, o e-mail da conta Google com que fez login e um número de WhatsApp em que possamos falar com você.
• Escolher o tipo de atendimento que corresponde à sua situação (Primeira consulta, Consulta ou Retorno).
• Usar o Serviço apenas para agendar atendimentos com a Cultivo Ornamental.
• Manter sua conta Google segura e não agendar em nome de outras pessoas sem a autorização delas.
• Cumprir a legislação aplicável.
4. Condutas Proibidas
Não é permitido:
• Fazer agendamentos falsos, fraudulentos ou duplicados, ou reservar horários sem intenção de comparecer.
• Usar nome, e-mail ou telefone de outra pessoa, ou se passar por outra pessoa.
• Usar robôs, scripts ou outros meios automatizados para acessar o Serviço.
• Tentar prejudicar o Serviço, acessá-lo sem autorização ou coletar informações de outros clientes.
• Transmitir vírus ou qualquer código malicioso.
Podemos cancelar agendamentos e bloquear o acesso ao Serviço de quem descumprir estas regras.
5. Agendamentos, Confirmação, Remarcação e Cancelamento
• Confirmação: o agendamento feito no Serviço reserva o horário. Podemos entrar em contato por WhatsApp ou e-mail para confirmar os detalhes.
• Remarcação ou cancelamento por você: avise-nos pelo WhatsApp ou pelo e-mail calendario.cultivoornamental@gmail.com, de preferência com pelo menos 24 horas de antecedência. Você também pode excluir o evento no seu Google Agenda; quando o Google perguntar, escolha avisar os convidados, para que sejamos informados.
• Remarcação ou cancelamento por nós: se precisarmos alterar ou cancelar um atendimento, avisaremos o quanto antes por WhatsApp ou e-mail e ofereceremos um novo horário.
• Disponibilidade: os horários exibidos como disponíveis podem mudar até a sua confirmação. Se dois agendamentos coincidirem, entraremos em contato para combinar outro horário.
6. Serviços do Google
O Serviço depende do login do Google e do Google Agenda. O uso desses serviços também está sujeito aos Termos de Serviço do Google e à Política de Privacidade do Google. Não nos responsabilizamos por falhas ou mudanças nos serviços do Google.
Você pode revogar o acesso do Serviço a qualquer momento em myaccount.google.com/permissions. Revogar o acesso impede novos agendamentos, mas não exclui os eventos já criados; você pode excluí-los no Google Agenda.
7. Propriedade Intelectual
O nome Cultivo Ornamental, o aplicativo Growing Calendar e os textos, o design e os elementos gráficos do Serviço pertencem à Cultivo Ornamental e são protegidos por lei. Não é permitido copiá-los, modificá-los ou redistribuí-los sem nossa autorização por escrito.
8. Isenção e Limitação de Responsabilidade
O Serviço é oferecido gratuitamente, "no estado em que se encontra" e "conforme disponível". Trabalhamos para mantê-lo funcionando corretamente, mas não garantimos que funcione sem interrupções ou erros.
Na medida permitida pela lei, a Cultivo Ornamental não se responsabiliza por danos indiretos decorrentes do uso ou da impossibilidade de uso do Serviço, incluindo falhas nos serviços do Google, problemas de conexão à internet ou informações incorretas fornecidas pelo usuário.
Nada nestes Termos exclui ou limita os direitos que você tem pelo Código de Defesa do Consumidor (Lei nº 8.078/1990) ou por outras leis que não podem ser renunciadas.
9. Suspensão e Encerramento
Você pode deixar de usar o Serviço a qualquer momento e revogar o acesso ao Google como descrito na Seção 6. Podemos suspender ou encerrar o Serviço, ou bloquear um usuário que descumpra estes Termos. Se o Serviço for encerrado, os atendimentos já agendados serão mantidos ou remarcados com você.
10. Alterações nestes Termos
Podemos atualizar estes Termos. A data de "Última atualização", no topo, indica a versão em vigor. Em caso de mudanças relevantes, exibiremos um aviso na página de agendamento antes que elas entrem em vigor. Se você continuar usando o Serviço depois disso, estará aceitando os novos Termos.
11. Lei Aplicável e Foro
Estes Termos são regidos pelas leis da República Federativa do Brasil. Eventuais conflitos serão resolvidos pela Justiça brasileira; se você for consumidor, poderá propor a ação no foro do seu domicílio, conforme o Código de Defesa do Consumidor.
12. Idioma
Estes Termos estão disponíveis em português e em inglês. Em caso de divergência entre as duas versões, prevalece a versão em português.
